CONSUMER AFFAIR DIVISION Consumer Service Manual (Draft) View Complaint Handling and Dispute Resolution Rules, 2007 (Draft) View Complaint Registration Form (MS-Word) View NEPRA’s Vision About Complaints NEPRA has to keep a window open to public for resolving complaints where the licensees are not adhering to the standards. This is also in accordance with the RGT&D Act 1997, Section 39 reproduce below: Complaints: – (1) Any interested person, including a Provincial Government, may file a written complaint which the Authority against a licencee for contravention of any provision of this Act or any order, rule, regulation, licence or instruction made or issued thereunder. (2) The Authority shall, on receipt of a complaint, before taking any action thereon, give notice to the licensee or any other person against whom such complaint has been made to show cause and provide such licencee or such other person an opportunity of being heard. NEPRA has to constantly monitor and enforce the service obligations which could only be done through a Consumer Affair Division. The cell is actively playing its part through vigilance and pro active role to redress the complaints of consumers. This is not only providing relief to consumers but is bringing more visibility to NEPRA. It is understood that although the day to day complaints cases will continue to be dealt by the Consumer Service Centres of the utility, the consumer complaints against the licencees (DISCOS), particularly of the nature as mentioned below will continue to come to NEPRA. It is important that NEPRA must keep track of the issues faced by the consumers as this will help NEPRA in monitoring and compliance of service obligations. The Consumer Affair Division will effectively be asking the licencees to redress the grievances of the consumers by close liaison with the Provincial Offices of Inspection and the liaison offices of NEPRA in the provinces. Introduction: The National Electric Power Regulatory Authority (NEPRA) was created through an Act of Parliament known as `Regulation of Generation, Transmission and Distribution of Electric Power Act (XL of 1997) passed by the National Assembly in December 1997. The Act provides the framework for regulation of the electricity sector in Pakistan. Under the terms of the Act, NEPRA is exclusively responsible for regulating the power sector. NEPRA is responsible for developing and implementing the regulatory framework in accordance with requirements and obligations set out in the Act, and in Rules and Licenses developed under the Act. 2. Under the Act, NEPRA is envisaged to be an independent and autonomous regulatory institution. Under the Section 42 (b) of the Act reproduced hereunder, NEPRA is obligated to produce a State of the Industry Report: Section 42. Reports of the Authority:(1) The Authority shall submit, to the Council of Common Interests and to the Federal Government, at the end of every financial year, but before the last day of September of that year(a) (b) a report on the conduct of its affairs for that year including anticipated developments for the following year; and a report on the state of electric power services in the country identifying the ownership, operation, management, efficiency and control of electric power facilities, amount of transmission and generation capacity, present and future demand of electricity, cost of electric power services and other matters relating to electric power services. The Islamic Republic of Pakistan is located in South Asia, sharing its borders with India in the east, China in the northeast, Iran in the southwest, and Afghanistan in the northwest. If deemed fit, public hearings are also held prior to the issuing of a licence in which all stakeholders have the opportunity to express their views. The determinations issued contain a discussion of all the relevant issues. 2. The following activities were undertaken by the Licensing Division during the year under review: Generation Licences Small Power Producers (SPPs) 3. Small Power Generating Units generate electricity for their own requirement and sale of surplus power to other industrial consumers in the nearby areas. The total installed capacity of these SPPs is of 1000-1500 MW and were established as a result of incentives provided under the 1994 Power Policy to encourage private investment in the power sector. they were operating their generation and distribution systems prior to enactment of NEPRA Act under authorization from provincial Governments WAPDA. The cancellations of generation licences of M/s Century Power G e n e r a t i o n Limited, M/s Nishat Power Limited and M/s Crescent Energy Limited were approved by the Authority on September 12, Sep. 13 and Dec. 1 2 , 2 0 0 5 r e s p e c t i v e l y. T h e cancellation was necessitated, on the request of the licencees, on account of change In business operations of the SPPs as the power generated was being used for self-consumption only. The case of cancellation of another SPP namely Kohinoor Textile Mills Limited was also processed. After the cancellation of licences the number of SPPs so far granted generation licences come to 22.
